ESR penalties and PDL accruals locked in for WA Doctors in Training

The AMA (WA) Industrial Relations team continues to deliver strong outcomes for Doctors in Training, with two recent wins that directly impact pay and entitlements.
Extended Shift Rate (ESR) & Overtime dispute update
After sustained advocacy, the AMA (WA) has secured confirmation from WA Health that Extended Shift Rate (ESR) penalties are payable on all hours worked, including those exceeding 80 hours per fortnight, not just ordinary hours. This is an important clarification, particularly as ESR penalties can exceed standard overtime penalties (e.g. 200% on Sundays).
Importantly, this change will apply retrospectively from the start of the 2024 Agreement (28 November 2024). WA Health has advised that an audit is underway, and we are awaiting final confirmation from HSS regarding implementation and backpay timelines.
PDL Accrual Issue Escalated and Resolved
AMA (WA) members recently brought to our attention that professional development leave (PDL) for DiTs was not accruing as per the current 2024 Agreement provisions e.g. three weeks accruing progressively.
Following our escalation, HSS has confirmed that system updates are underway to rectify this, with changes expected to be implemented by the end of August 2025. This timeline aligns with broader financial year processing, as well as a number of backpay matters we are pushing to be finalised before the end of financial year.
