$81,000 leave reinstated for Consultant

An experienced Senior Registrar employed by WA Health had accrued substantial leave entitlements over the course of their employment, including more than 700 hours of annual leave and 13 weeks of long service leave. Without the practitioner’s agreement and no break in service, the employer unlawfully paid out these entitlements.

The AMA (WA) stepped in to advocate on behalf of the practitioner. We contacted the employer, advising that the payout was unlawful and that the practitioner was entitled to retain their accrued leave. During this time, the practitioner advanced from Senior Registrar to Consultant.

After extensive discussions and continued advocacy by the AMA (WA), the employer reinstated the leave entitlements. Not only that but since the practitioner had since moved up to the Consultant level, the value of the leave was recalculated at the higher Consultant rate. This adjustment increased the value of the practitioner’s leave by over $81,000 compared to its original value as a Senior Registrar.
